A guide to the UK Law of Higher Education, providing treatment of the complex legal framework in which universities work and the remedies which may be sought in the event of disputes. It is useful for solicitors and barristers trying to keep up to date with this complex area of law, together with higher education administrators and employees.
Universities and colleges in the UK have to deal with many legal issues. Some are specific to the sector, such as; constitution and organisation; rights of members; relationships with students and academic staff; research contracts; information services; and student unions. Others are of a more general character, such as; employment; estates; and risk management. Whilst technically universities are private self-governing corporations, they in fact operate within a statutory public funding and regulatory regime, in addition to having all the legal responsibilities of major employers and landowners. A number have a student and staff population larger than that of small towns, manage significant public and private funds and are increasingly commercial in their outlook as they compete for the best students and staff, research grants and contracts, both in the UK and internationally. Colleges, while generally smaller, have a range of responsibilities very similar to those of universities.
This comprehensive and practical guide to the UK law of higher education provides extensive treatment of the complex legal framework in which universities work and the remedies which may be sought in the event of disputes. Although focussing on UK laws, it will include material on the international context, particularly important as institutions are increasingly involved in international exchanges and collaborations, as well as being subject to the increasing globalisation of higher education. The text is linked to the updating service on the OxCHEPS website so that users can keep up to date with developments. The book will be extremely useful for solicitors and barristers trying to keep up to date with this complex area of law, together with higher education administrators and employees.

Dr Dennis Farrington has been a university administrator since 1981, holding LLB and LLM degrees (London and Hull respectively). He is sole author of The Law of Higher Education (Butterworths, 1994, 1998) and has published numerous articles and papers, and contributed to the Codes of Practice and other policy material. He has been a consultant to Lawfords, Solicitors, in higher education law since 1994, consultant to Council of Europe on higher education legislation in Central and Eastern Europe since 1994. He has also acted as a Consultant in various projects funded by the World Bank (eg the education laws of Kosovo, 2000-2004, the education laws of Chechnya, 2002-2003) and the EU (eg higher education laws of Bosnia and Herzegovina, current; reform of legal education in Albania, current).He is a member of the International Strategic Expert Group advising the Minister of Education and Science on reform of higher and vocational education in the Russian Federation. David Palfreyman is Bursar & Fellow New College, Oxford (having previously worked at the University of Warwick and the University of Liverpool); Director, OxCHEPS (Oxford Centre for Higher Education Policy Studies), as located at New College, but independent of either New College or University of Oxford (see OxCHEPS web-site). He has also acted as a joint editor of;Higher Education Management (Open University Press, 1996, with David Warner); The State of UK Higher Education (Open University Press, 2000, with David Warner); Understanding Mass Higher Education: Comparative Perspectives on Access (Routledge and Falmer, 2005, with Ted Tapper); is joint author of Oxford and the Decline of the Collegiate Tradition (Woburn, 2003, with Ted Tapper); editor of The Oxford Tutorial (2002, OxCHEPS/Blackwells); and author of The Economics of Higher Education (2004, OxCHEPS). and also joint editor, of the journal, Education and the Law (Taylor & Francis).
