The modern state, which attempts to uphold peace, is bound by its laws and is limited in its power, is being confronted with new challenges to its domestic security. Technological developments and global networking are causing the boundaries between freedom and security to be realigned, while constitutional law demands that legislation, administration and jurisprudence return to defending our right to freedom. In the face of new and more sophisticated threats we are charged with the sizeable political and legal task of striking an appropriate balance between the two. "Nevertheless, in striking a balance between freedom and security we should not make radical changes" (Hans-Jurgen Papier).
This volume brings together contributions from the first in a series of conferences entitled "Forum Verfassungspolitik" (A Forum on Constitutional Policy) which took place at the Academy of Political Education in Tutzing. It documents the expert views of theoreticians and practioners.
