The aim of this book is to provide practitioners with an accessible and practical guide to the law and practice relating to the creation and enforcement of mortgages. It deals with many of the issues which often arise in the course of litigation in this area of law.
This book is the only modern work to deal exclusively with drafting, registration and enforcement of mortgages. As such, the book will be of use to both solicitors and barristers who seek guidance on the intricacies of the law on mortgages. It also clarifies the various procedures to be followed when pursuing a mortgage suit.
The book also contains an appendix of sample pleadings and documents to assist the practitioner in the drafting of legal pleadings in this area.

"Throughout, Maddox treats the various elements of mortgages in as the title suggests both law and in practice and he seems, to this reviewer, to have achieved an excellent balance between exposition and application in this endeavour. In his preface, Dr Maddox notes that the High Court mortgages list is now under the careful stewardship of Justice Dunne, who wrote the foreword. To that it can be added that those acting in cases on that list are recommended to have recourse to this careful, well-researched, clearly written and thoughtful volume."

Dr. Neil Maddox B.L. is a practising barrister and a Lecturer in Commercial and Business Law in the National University of Ireland, Maynooth.
