The number of biotechnology patent applications has doubled within seven years from 7,000 in 1988 to 14,000 in 1994. The relevant state-of-the-art has grown exponentially and so have problems, which patent offices, courts, applicants as well as their competitors have to master whenever they are dealing with the patentability of biotechnology inventions.
The complexity of the issues at stake is also well reflected in the increasing number of appeals in biotechnology cases and decisions. The new decisions of the Enlarged Board of Appeal of the EPO are assembled, summarized and commented in this book. The co-authors offer concise valuable information on the parallel statutory and case law in the U.S.
