This book uses humanity-rationality and experience and the freedom of human will as a theoretical perspective to examine the basic framework of criminal law theories constructed by the criminal classic school and the criminal empirical school. The author puts forward the principle of the duality of rationality and experience of humanity and affirms the determinism of human behavior in the ontological sense and the freedom of will in the axiological sense. From this point of view, this book examines the humanistic foundations of crime and punishment, legislation and justice.

Xingliang Chen, Chinese contemporary famous scholar in the science of criminal law, Professor, and doctoral supervisor at Peking University Law School, was the vice-chairman of the Chinese Association of Criminal Law, the Chinese Society of Criminology, and the Chinese trial theory Research Institute. He also severed as a member of the Social Science Commission of the Chinese Ministry of Education, an expert of the National Social Science Foundation Disciplines Review Group. Professor Chen was awarded the International Academic Award of the American Society for Criminal Sociology in 2007 and the Honorary Membership of the Japanese Society of Criminal Law in 2010. He published more than 400 academic papers, and published Criminal Law Series with 31 volumes in China Renmin University Press and “Portfolio” of his works with 10 volumes in Peking University Press. What’s more, the book The Transformation of Criminal Theories: An Intellectual History was translated into Japanese and published in Japan, and the book Philosophy of Criminal Law was translated into English and published in the United States.
