This is the first major update to the 22nd edition of Scrutton on Charterparties and Bills of Lading, the leading statement of general principles in the fields of time charters, voyage charters, demise charters and bills of lading. First published in 1886, Scrutton has provided a first port of call for research when drafting contracts or dealing with disputes for generations. The Supplement is to be read side by side with the 22nd edition.
It updates the existing text in particular by reference to more than 50 new cases since the 22nd edition (2011), covering a wide field of topics including: - the formation of charterparties (The Pacific Champ [2012]) - duress (The Cenk Kaptanoglu [2012]) - frustration (The Kyla [2012]) - bills of lading (Finmoon v Baltic Reefers [2012], The Saga Explorer [2012], The Erin Schulte [2013]), - perils of the sea (The DC Merwestone [2013]), - discharge and delivery of cargo (The Falkonera [2013], The Dolphina [2012]), - time charters (The Wren [2011], The Aquafaith [2012], The Kos [2012], The Western Moscow [2012], The Astra [2013]) - liens (The Bulk Chile [2012]) The author team is led by The Hon Mr Justice Eder and includes three leading QCs at Essex Court Chambers; Steven Berry QC, David Foxton QC and Christopher Smith QC, all of whom have extensive practical experience in the shipping and commercial fields, as well as the leading academic, Professor Howard Bennett of Nottingham University. All contributed to the 22nd edition of the work and this Supplement.
