International HIPAA, Privacy and Security Law Considerations addresses the old and new generations of cybersecurity laws, compliance requirements, and threats, which need to be considered in conjunction with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) – a law that celebrated its 25th anniversary in August 2021 and continues to evolve.

International cybercriminals have become more brazen, as attacks in 2021 and 2022 were aimed at children’s hospitals – Boston’s Children’s Hospital and SickKids in Toronto, Canada. Actions like those perpetrated on children’s hospitals, as well as other infrastructure considerations, such as the Colonial Pipeline prompted Executive Order 14028 – Improving the Nation’s Cybersecurity, which called for the public and the private sectors to improve its prevention, detection, and correction of cyber risks and events. Government agencies, including the U.S. Department of Justice acted and implemented cyber-fraud and other cybersecurity enforcement initiatives.

Cybersecurity risks continue to escalate. Now more than ever, healthcare industry participants – whether covered entities, business associates, or subcontractors – should utilize resources such as those set forth by the U.S. Department of Health and Human Services (HHS), Health Sector Cybersecurity Coordination (HC3).

Rachel V. Rose, JD, MBA, advises and represents clients in compliance, transactional, litigation, and government enforcement matters involving healthcare, cybersecurity, securities, False Claims Act and Dodd-Frank matters. Ms. Rose is also an affiliated member with the Baylor College of Medicine’s Center for Medical Ethics and Health Policy, where she teaches bioethics. She is often quoted as an expert. Ms. Rose is licensed in Texas and is a Fellow of the Federal Bar Association. Currently, she is a director on the Federal Bar Association’s National Board, is a member of and the immediate past chair of the Federal Bar Association’s Government Relations Committee, and is an Advisory Board member of the Federal Bar Association’s Qui Tam Section. Ms. Rose is the co-editor of the American Health Lawyers Association’s Enterprise Risk Management Handbook for Healthcare Entities (second edition), as well as a co-author of the ABA’s books The ABCs of ACOs and What Are International HIPAA Considerations? She is extensively published and presents on a variety of matters related to her practice. She has been named consecutively to the Texas Bar College, the National Women Trial Lawyers Association’s Top 25, Houstonia Magazine’s Top Lawyers (healthcare), the National Trial Lawyers Association’s Top 100, as well as 1st Healthcare Compliance’s 2019 Top Presenter. Ms. Rose co-represented Relator Dr. Shawn Lawler in the False Claims Act lawsuit, which resulted in the first settlement obtained by the U.S. Department of Justice under its Cyber-Fraud Initiative.11 Lance H. Rose, MHA, MS, LFACHE, is a retired hospital chief executive officer with more than 40 years of healthcare experience. Mr. Rose has served on numerous boards, including the American Hospital Association’s Regional Policy Board and BlueCross BlueShield. He also taught as an adjunct professor at The Pennsylvania State University and has authored and co-authored a variety of articles and books, including What Are International HIPAA Considerations?
