Die Einrede der doppelten Inanspruchnahme. (eBook)

Die Einrede der doppelten Inanspruchnahme und der Doppelschutz sind auf die europäische Patentreform zurückzuführen. Diese steht für die Einführung einer einheitlichen europäischen Patentgerichtsbarkeit in Gestalt des Einheitlichen Patentgerichts und die Schaffung eines europäischen Schutztitels, des europäischen Patents mit einheitlicher Wirkung. Aus Anlass der europäischen Patentreform wurde u. a. das Begleitgesetz vorgeschlagen, das die Anpassung der nationalen Vorschriften zum Gegenstand hat. Es sieht als Novum die Einführung eines Doppelschutzes durch ein nationales Patent und einen europäischen patentrechtlichen Schutztitel vor. Gleichzeitig wird der Doppelschutz durch die Einrede der doppelten Inanspruchnahme beschränkt. Die Arbeit widmet sich der wissenschaftlichen Untersuchung beider Institute und gelangt zum Ergebnis, dass mehr und die besseren Argumente für die Einführung des beschränkten Doppelschutzes sprechen.

Bernadette Makoski studied law in Düsseldorf, Germany, and Cergy-Pontoise, France. She has been supported by the Studienstiftung (German Academic Scholarship Foundation). In Düsseldorf, she worked inter alia at the Chair for Public and Administrative Law and at the Chair for Civil Law and Industrial Property Law. She obtained her LL.M. and her doctorate at the Heinrich-Heine-University of Düsseldorf, where she gives lectures. During her legal clerkship she worked for the European Commission. She is judge at the Regional Court of Düsseldorf and works for the Higher Regional Court in Düsseldorf. She already worked for the Federal Ministry of Justice and Consumer Protection in Berlin and at the Court of Justice of the European Union in Luxembourg. Bernadette Makoski prepares a habilitation about »Ubiquitary goods« at the Faculty of Law of the Heinrich-Heine-University of Düsseldorf. Sie is a member of the selection committee of the German Academic Scholarship Foundation and an examiner in the second state exam as a member of the Juridicial Examination Office of the Land of North Rhine-Westphalia.
