This book addresses the pluralisation of family forms as an expression of the transformation of society and its normative foundations. Against a legal background, the development of diverse family concepts and practices is examined and the (severed) links between sexuality, gender and reproduction are explored.
The interrelationships between sexuality, gender and reproduction are no longer self-evident. As a result, family concepts are everchanging. This book examines these issues and focuses on the manifold challenges for jurisprudence and legislation that are influenced by today's pluralisation of family forms and divisive tensions that accompany social and normative transformations, such as the increasing recognition of same-sex partnerships and LGBTQI+ families. In particular, assisted reproductive technologies can lead to a severance of biological, genetic and social family links. Against this background, how should legal concepts of partnership, family and parenthood be constructed in the future? How do the highest courts and human rights help shape new legal approaches? Are there common trends of co-existing legal systems? Where does the international community of states risk breaking apart? And what role does representation of diverse families in (new) media and art play? To answer these questions, this book brings together international expertise, namely from Australia, Austria, Germany, Poland, Portugal, South Africa and the USA.
